Is Deadline working with Max 2010?

Not yet. We hope to release a service pack release for Deadline 3.1 in the near future that includes support for 3dsmax 2010.

what is the near future? we have licenses of 2009 and 2010 sitting around waiting to be installed, but we dont want to install 2009 today then upgrade to 2010 in a week.

At the latest - end of May. We might put out a 2010 patch out before that once we get the plugin working and can confirm that it will work with 3.1 and won’t require 3.1 SP1.
