As 3ds Max does not require licensing when installed on non workstation render nodes on a farm, why do we need licenses for 3ds Max when running Spot Fleets?

Use of Autodesk licenses on the Cloud are subject to Autodesk’s “Cloud Rights”. Customers are allowed to run the software on a limited number of cloud instances.
The limit is based on the number and type of on-premises licenses; see the Subscription Benefits FAQ: Cloud Rights for 3ds Max and Maya for details. Anything beyond this number requires either a purchase of more on-premise licenses or the use of a Autodesk Cloud Licensing model such as AWS Thinkbox’s Usage Based Licensing which can be purchased from the Thinkbox Marketplace.
Autodesk products on the Thinkbox Marketplace are only compatible with AWS Portal Amazon Machine Images and AWS Portal’s pre-configured Autodesk AMIs for Maya and Max are only compatible with Usage Based Licensing.
You must install the full version of the Autodesk product on your AMI to use your existing licenses. By default, our AMIs use 3dsmaxio/mayaio, which is a different product that uses the UBL from our marketplace.
